If you have any queriesabout the use of your personal information, artiste or supplier information on our website, or about thisPrivacy Policy, please contact us.These Terms & Conditions of Business apply to all bookings, engagements, services and arrangements madethrough Pure Global International Ltd (“Pure Global”) and are intended to operate in accordance with theConduct of Employment Agencies and Employment Businesses Regulations 2003 (“the Regulations”), whereapplicable.

1. OUR ROLE

Our website may use cookies. A cookie is a small data file stored on your device or within your browser whenyou visit a websitePure Global International Ltd acts primarily as an Employment Agency in compliance with the Regulations.

Where acting as an Employment Agency, Pure Global acts as agent for the Artiste/Supplier. Whilst bookingsare arranged and administered by Pure Global, the engagement itself is between the Hirer and the relevantArtiste/Supplier unless expressly stated otherwise.

Where Pure Global acts as an Employment Business, or contracts directly to provide services including butnot limited to productions, creative services, event delivery, décor, theming, props, equipment, technicalservices or staffing, this will be identified within the relevant booking confirmation, proposal or contract. Inthese circumstances, the Hirer's contract will be directly with Pure Global International Ltd.

2. ARTISTES, SUPPLIERS & SERVICES

Pure Global confirms that it has, or will obtain, appropriate authorisation from the Artiste/Supplier to act ontheir behalf for the purpose of seeking, negotiating and securing engagements.

Pure Global will make reasonable enquiries regarding the suitability of Artistes/Suppliers and obtain relevantinformation as required under applicable legislation.

Where appropriate, Pure Global may subcontract an Artiste, Supplier or service through another EmploymentAgency, Employment Business or third-party supplier. Pure Global will take reasonable steps to ensure theappropriate contractual arrangements and permissions are in place.

3. SITE VISITS & EVENT REQUIREMENTS

Site visits may be required for certain events, productions or services. Where a site visit is considerednecessary, Pure Global will advise the Hirer of any applicable charges or associated costs.The Hirer must provide accurate information regarding the venue, event and any health and safetyrequirements, restrictions or other matters that may affect delivery of the booking.Failure to disclose restrictions which prevent an Artiste/Supplier or Pure Global from delivering the contractedservice will not remove the Hirer's obligation to pay the agreed fees.

PERSONAL DATA WE COLLECT ABOUT YOU

Depending on how you interact with Pure Global and use our services, we may collect:

  • Your name and contact details, including email address, telephone number and postal address.
  • Information you provide when completing an enquiry or contact form.
  • Information you provide through forms on our website.
  • Information provided when arranging or discussing a booking for an artiste, production, product or service.
  • Business and billing information required to administer bookings, contracts and invoices.
  • Information relating to your role, company or organisation where relevant to our business relationship.

4. INSURANCE & SAFETY

Artistes and Suppliers are expected to maintain appropriate Public Liability Insurance and, where applicable,ensure electrical equipment is appropriately tested and certified.

The Hirer must maintain suitable insurance for the venue/event and ensure that the performanceenvironment, electrical supply and facilities are safe and suitable. Where the venue is operated by a thirdparty, the Hirer is responsible for ensuring that the venue operator meets these requirements.

5. PROPS, EQUIPMENT & HIRED ITEMS

All props, equipment, décor, costumes and other hired goods remain the property of Pure Global or therelevant Supplier at all times.

Pure Global or the Supplier reserves the right, where reasonably necessary, to substitute hired equipment withequipment of a similar specification, appearance and value.

The Hirer will be responsible for any loss or damage occurring to hired items whilst they are under the Hirer'scontrol, except for reasonable wear and tear.

6. CONFIRMING A BOOKING

Once a booking has been confirmed verbally, electronically, by email or in writing between the relevantparties, the booking will be considered binding.

Failure or refusal to subsequently sign booking documentation does not automatically constitute cancellationor termination of an agreed booking.

Pure Global will issue appropriate booking documentation, confirmation or contract which should be checkedcarefully by the Hirer. Any inaccuracies must be brought to Pure Global's attention as soon as reasonablypossible.

7. RIDERS & ADDITIONAL REQUIREMENTS

Where an Artiste/Supplier has additional technical, hospitality, travel, accommodation or performancerequirements, these may be included within a rider or booking documentation.Pure Global will endeavour to make the Hirer aware of any material additional costs before the booking isconfirmed.

8. PAYMENT TERMS

Payment terms will be clearly stated on the relevant quotation, booking confirmation, invoice or contract.All invoices must be paid within the payment terms specified. Where deposits or advance payments arerequired, the booking will not be considered financially secured until the required payment has been received.Where payment is to be made directly to an Artiste/Supplier, this will be clearly stated within the bookingdocumentation. Unless expressly agreed otherwise, all fees quoted are exclusive of VAT where VAT isapplicable.

9. LATE PAYMENT

Pure Global reserves the right to charge statutory interest and reasonable debt recovery costs on overduecommercial invoices in accordance with applicable UK legislation.

Failure to make payment when due may result in Pure Global suspending or cancelling future services orbookings without prejudice to its right to recover outstanding monies.

10. VENUE RESPONSIBILITIES

The Hirer must ensure that the venue is safe, suitable and properly licensed for the contracted entertainment,production or service.

The Hirer must notify Pure Global in advance of any physical obstacles, access restrictions, noise restrictions,licensing conditions, load-in difficulties or other circumstances which may affect delivery.

Where a booking cannot proceed because of venue restrictions or circumstances that were not disclosed toPure Global prior to confirmation, the full contracted fee may remain payable.

11. DRESSING ROOMS & FACILITIES

Where reasonably required, an adequate and preferably lockable dressing room or secure area must beprovided for Artistes/Suppliers to change and safely store personal belongings and equipment.

Any additional hospitality requirements will be specified within the booking confirmation or rider.

12. COMPLAINTS

Any problem relating to an Artiste, Supplier or service should be brought to Pure Global's attention at theearliest reasonable opportunity so that we have an opportunity to resolve the issue.

Where a complaint cannot be resolved during the engagement, the Hirer should submit the complaint inwriting within 7 days of the event. Pure Global will endeavour to investigate the matter fairly and facilitate anappropriate resolution.

13. CANCELLATION BY THE HIRER

Unless different cancellation terms are expressly stated within the individual booking contract, the followingcancellation charges may apply:

More than 90 days before the engagement: Any deposit paid may be retained.

Between 30 and 90 days: Up to 50% of the total contracted fee may become payable.

Between 14 and 30 days: Up to 75% of the total contracted fee may become payable.

Within 14 days of the engagement: Up to 100% of the total contracted fee may become payable.

Pure Global and/or the Artiste/Supplier will take reasonable steps where appropriate to mitigate losses arisingfrom cancellation. Special dates, including but not limited to Christmas Eve, Christmas Day and New Year'sEve, may be subject to different or higher cancellation provisions where specified within the bookingagreement.

14. FORCE MAJEURE

Neither party shall be liable for failure to perform its obligations where performance is prevented bycircumstances genuinely outside that party's reasonable control.

Such circumstances may include severe weather or natural disaster, war, terrorism, civil disturbance,Government restrictions, epidemic or pandemic, accident, venue closure caused by circumstances outsidethe parties' control, death or appropriately evidenced serious illness.

The affected party must notify the other party as soon as reasonably practicable. Any monies due orrefundable following a Force Majeure event will be dealt with in accordance with the circumstances of thebooking and any specific contractual provisions applying to it.

15. ARTISTE ILLNESS OR UNAVAILABILITY

Where an Artiste/Supplier is unable to fulfil an engagement due to illness, accident or another legitimatereason, Pure Global will notify the Hirer as soon as reasonably practicable.

Pure Global will use reasonable endeavours to source a suitable replacement where possible. The Hirer willnot be obliged to accept a proposed replacement unless otherwise agreed within the specific bookingcontract.

Where no suitable replacement can be provided and the original engagement cannot proceed, monies paidspecifically for the unavailable Artiste/Supplier will be refunded where appropriate.

16. CHANGES ON THE DAY

Where both parties agree to changes to timings, performance duration, running order or other bookingrequirements on the day of the engagement, those agreed changes will form part of the bookingarrangements.

Any additional charges resulting from such changes must be agreed between the relevant parties.

17. PERFORMANCE STANDARDS

Artistes/Suppliers must adhere to agreed timings and booking requirements and arrive with sufficient time toprepare for their performance or service.

Artistes/Suppliers are expected to perform and present themselves substantially “as known” and aspromoted at the time of booking.

Any material change to the advertised line-up, format or performance should be notified to Pure Global inadvance. Where a deputy performer (“dep”) is required, the replacement must be of an appropriateprofessional standard and, where reasonably practicable, discussed with Pure Global and the Hirer before theengagement.

18. PROFESSIONAL CONDUCT

All Artistes, Suppliers, freelancers, contractors and representatives working through Pure Global are expectedto behave professionally and courteously.

Excessive alcohol consumption, illegal drug use, abusive behaviour, inappropriate language, unsafe conductor an unacceptable standard of presentation while representing a Pure Global booking may constitute aserious breach of these Terms.

19. SECURITY & RIGHT TO STOP PERFORMANCE

The Hirer is responsible for providing appropriate security arrangements where reasonably required.

Where an Artiste/Supplier reasonably considers that there is an immediate threat to their health or safety,including threatening or seriously disruptive audience behaviour, they may temporarily stop the performanceuntil the threat has been addressed.

Where the threat cannot reasonably be resolved and continuing the performance would expose theArtiste/Supplier to an unacceptable risk, they may cease performing. The contractual fee may remain payablewhere the circumstances were outside the Artiste/Supplier's control

20. EQUALITY, DIVERSITY & RESPECT

Pure Global International Ltd operates a zero-tolerance approach to racism, discrimination, harassment,bullying and abuse.

All staff, Artistes, Suppliers, freelancers, contractors, clients and audience members must be treated withdignity and respect.

Discrimination or harassment relating to race, ethnicity, nationality, sex, sexual orientation, genderreassignment, age, disability, religion or belief, or any other legally protected characteristic will not betolerated.

21. CLIENT & BOOKING PROTECTION

For a period of 12 months following an engagement or introduction, the Hirer must negotiate any repeat,additional or related booking for an Artiste/Supplier introduced or supplied by Pure Global through Pure GlobalInternational Ltd.

The Hirer must not knowingly circumvent Pure Global by approaching, engaging or contracting directly with anArtiste/Supplier introduced through Pure Global for the purpose of avoiding Pure Global's involvement, fees orcommission.

This provision applies whether the subsequent engagement is identical to the original booking or involves theArtiste/Supplier providing substantially similar entertainment or services.

22. RENEWALS, EXTENSIONS & REBOOKINGS

Commission and/or agency fees may remain payable to Pure Global in relation to renewals, extensions andrebookings resulting from an introduction or engagement originally secured through Pure Global.

Unless otherwise agreed in writing, this protection will apply for a period of 12 months following the originalengagement or introduction.

23. INTELLECTUAL PROPERTY & PURE GLOBAL MATERIALS

All intellectual property, concepts, creative materials, show formats, production designs, artwork, graphics,promotional materials, arrangements, scripts, music production, video content and other assets created orcommissioned by Pure Global remain the property of Pure Global International Ltd or the relevant rights holderunless expressly transferred in writing.

No such materials may be copied, reproduced, transferred, distributed, adapted or supplied to a third partywithout prior written permission.

Third-party intellectual property and licensed properties remain subject to the rights and restrictions of theirrespective owners and licensors.

24. PHOTOGRAPHY, VIDEO & PROMOTIONAL CONTENT

Unless otherwise agreed, the Hirer must obtain Pure Global's prior permission before commercially exploitingprofessional photographs, video footage or recordings of a Pure Global-owned or managed production wheresuch use extends beyond normal promotion of the booked event.

Any use of licensed characters, trademarks or intellectual property will additionally be subject to therequirements of the relevant rights holder

25. LIABILITY

Pure Global will exercise reasonable care and skill when arranging and/or providing services.

Where Pure Global acts solely as an Employment Agency, Pure Global shall not be responsible for lossesarising solely from the independent acts or omissions of an Artiste/Supplier except to the extent that liabilitycannot lawfully be excluded.

Pure Global will not be liable for indirect or consequential losses including loss of profit, loss of ticket revenue,marketing expenditure or reputational loss arising from cancellation or non-performance, except where suchliability cannot legally be excluded.

Nothing within these Terms excludes or limits liability where it would be unlawful to do so.

26. GOVERNING LAW

These Terms & Conditions and any dispute arising from them shall be governed by the laws of England andWales.

The courts of England and Wales shall have jurisdiction in relation to any dispute arising from these Terms,subject to any mandatory legal rights which apply.

28. ACCEPTANCE OF TERMS

By confirming a booking with Pure Global International Ltd, the Hirer acknowledges that they have read,understood and accepted these Terms & Conditions together with any specific terms contained within therelevant quotation, confirmation, rider or contract.
